Refund policy
Under Texas state law, alcoholic beverages can be returned if the product is unopened, sealed, and in its original packaging. Most retailers have the right to refuse a return; CMK Cellars reserves the right to refuse a refund, each circumstance considered individually. The Texas Alcoholic Beverage Commission (TABC) states that once alcohol is sold, it is the property of the buyer, and the seller has no obligation to accept returns or offer refunds. Once the wine is purchased, it is considered a final sale and cannot be returned for a refund. Though not exhaustive, there are acceptable situations in which wine can be exchanged for a similar one in Texas:
1) The integrity of the product was compromised upon or before delivery/purchase.
2) The product was unfit for consumption (infiltrated, sedimented, etc.).
3) The product is considered a consumer safety issue (for example, mold, chemical residues, undisclosed ingredients, incorrect labeling, etc.)
As a perishable item, CMK Cellars is not responsible for and will not replace wine damaged by extreme weather conditions, both cold and hot. When the wine order is picked up by the common carrier for delivery, responsibility for the wine becomes the responsibility of the purchaser.
If purchased from any type of 3rd party not affiliated with CMK Cellars (ie. retailer, website, delivery service, restaurant, etc.), CMK Cellars will be unable to replace or refund the purchase. Please contact the 3rd party the bottle was purchased from.
Shipments where the provided address information is incorrect or incomplete and are returned to us as undeliverable will either be reshipped at the expense of the customer or refunded, minus applicable shipping & return fees.
